Legal battle continues between Peloton & NordicTrack / ICON – Peloton alleges Trade Secrets Stolen

The long running legal battles between Peloton & ICON Health & Fitness (makers of NordicTrack treadmill and brand) are continuing this week in court. Peloton has filed a new lawsuit (currently under seal) claiming that ICON stole trade secrets from Peloton, as first reported by Bloomberg. The case is Peloton Interactive Inc. v. ICON Health & Fitness Inc., 20-cv-1535, U.S. District Court, District of Delaware (Wilmington)

The lawsuit is “based on Icon’s fraudulent campaign to improperly acquire Peloton’s trade secret advertising plans.”

In public court filings, Peloton said the confidential information Icon allegedly tried to steal included its “planned advertising and marketing strategy, descriptions of the advertisements and strategic discussions, and future confidential, unannounced features and plans.” The information also included excerpts of contracts between Peloton and its advertising and production companies, court documents show.

More details could be revealed later this week, as Peloton has 7 days to file a redacted version of the complaint. Bloomberg also reports that ICON has responded, saying this new lawsuit is ‘“baseless” retaliation for a patent-infringement claim Icon made against Peloton last month.’

Peloton’s theft claim is “an unabashed attempt to distract people” from its “ongoing and brazen misappropriation of Icon’s intellectual property,” Icon lawyer Sterling Brennan said.

This is the third separate legal case filed between the two companies this calendar year. It began in May, when Peloton filed suit against ICON for patent infringement & for misleading advertising. In October, ICON sued Peloton, alleging patent infringement for new features found in the Bike+.
