The court battle continues over Peloton’s Bike+ trademark as the plaintiff in the original lawsuit, World Champ Tech LLC, has filed an appeal.
In May 2021, a lawsuit was filed against Peloton by World Champ Tech, which claimed that Peloton was infringing on a trademark the company owned for the Bike+ name. World Champ Tech has an iPhone app called “Bike+”. The case slowly made its way through the court system.
Then, in February 2024, the judge ruled in favor of Peloton, stating that “there is no likelihood of confusion” between the Peloton Bike+ and the app Bike+. This seemed to be the end of the case. However, in the ruling, the judge had noted that there were some factors in World Champ Tech’s favor, but overall, confusion was not likely.
Following the ruling, World Champ Tech filed asking the court for reconsideration of the ruling on March 14. This led to a March 26th ruling, with the judge denying the motion for reconsideration. In that ruling, the judge said:
“In the end, the court thinks that its descriptiveness holding is sound. There is evidence in the record, beyond conventional meanings, to support the holding. For example, many other companies have used a plus sign next to another word to convey additional quality, and such a plus sign’s meaning has been described in mass media. The court denies the motion for reconsideration on this ground.”
This has led World Champ Tech to file an appeal to the United States Court of Appeals for the Ninth Circuit. This appeal, filed on April 8, 2024, is asking the higher court to intervene and reconsider the ruling.
It is not known yet whether the court will take up the appeal, or if it will keep the case and ruling closed.
