Peloton is facing a legal challenge in Florida, where a Broward County resident has filed a proposed class action lawsuit accusing Peloton’s apparel division of repeatedly sending unwanted marketing text messages (i.e. spam) – even after they attempted to opt out.
The complaint, filed on June 27, 2025, alleges that Peloton violated the Telephone Consumer Protection Act (TCPA) by continuing to send promotional messages for Peloton Apparel after the individual replied with a “STOP” request on March 26. Despite that, the lawsuit claims, Peloton sent them at least 12 more messages, including examples from June 15, 16, and 18. The lawsuit provides screenshots of the messages.

The lawsuit details how Peloton’s actions allegedly demonstrate a failure to honor opt-out requests and a lack of compliance with federal telemarketing regulations. Specifically, the lawsuit accuses Peloton of not:
- Maintaining a written policy for honoring do-not-contact requests;
- Training staff on how to follow opt-out procedures;
- Keeping an internal do-not-call list.
These alleged shortcomings, the complaint says, violate 47 C.F.R. § 64.1200(d), which requires companies to implement and follow clear protocols for honoring consumer requests to stop marketing communications.
The individual is seeking financial compensation – otherwise known as statutory damages – of up to $1,500 per violation, as well as a court order requiring Peloton to implement proper compliance practices.
The individual also aims to represent a broader class of consumers across the U.S. who received multiple marketing texts from Peloton after opting out – amounting to a class action lawsuit. The proposed class includes all individuals who received two or more such messages within a 12-month period after issuing a stop request.
According to the suit (Armas v Peloton Interactive), the issue is not isolated. The individual claims Peloton uses automated systems to send widespread marketing texts and that their experience may reflect systemic noncompliance.
Peloton has not publicly commented on the lawsuit as of publishing time.
